Precedent and Authority Research

I can help you with thorough precedent and authority research for your case, meticulously examining relevant case law from the Circuit Court, Superior Courts, and Supreme Court to identify supporting precedents. My research encompasses all applicable legislation, ensuring a complete understanding of the statutory framework governing the client's situation. I'm also deeply familiar with the rules and procedures of each court, and I will explain everything you need to do to ensure you comply when you compile, prepare, and file your documents and submissions.
What Research I Undertake
Understanding the Process

For clients dealing with mortgage arrears or property disputes, understanding the paperwork is half the battle.

Identifying Resources: Based on the nature of your dispute, I can identify which applications or forms are generally required by the Courts or Property Registration Authority (e.g., specific Affidavits or Registration forms). I provide you with blank copies of these forms or direct links to where they can be downloaded.

Completing Your Documentation: Once you have the correct forms, it is your responsibility to fill them out. I cannot draft the content for you. However, I can assist you in organising the factual exhibits (such as bank statements or historical maps) that you may wish to attach to your application.

Case Law Library: I conduct extensive research to find judgments and precedents relevant to your situation. I provide you with copies of these judgments for you to study, helping you understand how judges have ruled in similar cases in the past.

Research for Property Applications

Evidence Gathering for Adverse Possession

Applying for adverse possession requires a strict burden of proof regarding the history of the property.

My Service:

I specialise in the historical and factual research required to support these applications. I can assist you in:

Tracing historical owners and beneficiaries. Locating historical maps and utility records to prove occupation. Organising your evidence timeline.

The Application Process: Once this factual evidence is gathered, it is used to support an application to the Property Registration Authority (such as Form 17, Section 49 and Form 5 or 6). Please note: I do not draft or submit the Forms or application. I provide you with the organised evidence pack so that you or your solicitor can submit the formal application.

Fees and Appointments

My fees are charged strictly for time spent on research, mediation, and administrative organisation.

Initial Consultation: Appointments are required. Please ensure you bring all relevant files and correspondence. We will review the state of your paperwork and determine if I can assist you in organising your files or mediating your dispute.
